Please read these Terms of Service (“Terms”) carefully before placing an order with Oli and Oak. By using our website or purchasing from us, you agree to be bound by these Terms.
1. About Us
Oli and Oak is a custom portrait business registered in Sharjah, United Arab Emirates (trading as “Oli & Oak”, “we”, "us ","our "). Our website and services are offered subject to these Terms.
2. Orders & Contract
A contract is formed between you and Oli & Oak when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, or inability to fulfil the order.
3. Custom Products
All portraits are made to order. By submitting your order, you confirm that:
- You have the right to use the photos you upload
- The images you provide are suitable in quality for portrait creation
- You understand that the final artwork is a creative interpretation and may not be an exact replica of the photo
4. Pricing & Payment
All prices are listed in UAE Dirhams (AED) unless otherwise stated. Prices include applicable taxes where required. Payment must be made in full at the time of ordering. We accept payment via the methods available at checkout.
Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product or service at any time without notice. We shall not be liable to you or any third party for any modification, price change, or discontinuation of a product or service.
5. Accuracy of Website Information
The information on our website is provided for general purposes only. We make every effort to ensure it is accurate and up to date, but we cannot guarantee that all content is complete, current, or error-free. Any reliance on the material on this site is at your own risk. We reserve the right to modify the contents of our website at any time without notice.
6. Errors & Omissions
Occasionally there may be information on our website that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, or availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice, including after you have submitted your order.
5. Artwork Production
To ensure efficient turnaround, Oli & Oak does not provide artwork previews, proofs, or revision rounds prior to printing. If the photograph you provide is unlikely to produce the best result, we will contact you to request an alternative before production begins. We encourage customers to review our Image Guidelines carefully before ordering.
You may request changes to your order within 30 minutes of placement, provided production has not yet begun. After production has started, we cannot guarantee that amendments can be made.
6. Cancellations
Orders may be cancelled within 30 minutes of placement for a full refund, provided illustration work has not yet begun. After 30 minutes, cancellation requests will be considered at our discretion, as our artists often begin work as soon as an order is placed. Once production has started, orders cannot be cancelled.
7. Delivery
We aim to dispatch all orders within 1–2 weeks. During peak periods, including holidays and seasonal demand, delivery may take up to 3 weeks. Delivery times are estimates and are not guaranteed. Oli & Oak is not liable for delays caused by third-party couriers, customs, or circumstances beyond our control.
8. Intellectual Property
The artwork created by Oli & Oak remains the intellectual property of Oli & Oak and our artists until full payment has been received. Upon payment, you are granted a personal, non-commercial licence to use the artwork for your own purposes. You may not reproduce, sell, or distribute the artwork commercially without our written consent.
By uploading a photo, you grant Oli & Oak the right to use the image solely for the purpose of creating your portrait. We may also use completed portrait images for marketing purposes (e.g. on our website or social media) unless you instruct us otherwise.
9. Limitation of Liability
To the fullest extent permitted by law, Oli & Oak’s total liability to you in connection with any order shall not exceed the amount you paid for that order. We are not liable for any indirect, consequential, or special losses arising from your use of our services.
10. Prohibited Uses
You are prohibited from using our website or its content:
- For any unlawful purpose
- To violate any applicable laws or regulations
- To infringe upon the intellectual property rights of Oli & Oak or any third party
- To submit false or misleading information
- To upload or transmit viruses or any other malicious code
- To collect or track the personal information of others
- To spam, scrape, or crawl our website
- To interfere with or circumvent the security features of our website
We reserve the right to terminate your access to our website for violating any of the above.
11. Indemnification
You agree to indemnify and hold harmless Oli & Oak and its partners, service providers, and employees from any claim or demand, including reasonable legal fees, made by any third party arising from your breach of these Terms or your violation of any law or the rights of a third party.
10. Governing Law
These Terms are governed by the laws of the United Arab Emirates and the Emirate of Sharjah. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Sharjah, UAE.
11. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.
12. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Oli & Oak regarding your use of our website and services, and supersede any prior agreements or communications between us.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms. We will notify you of significant changes where possible.
